| Why is there a User Agreement? |
|
The User Agreement is a legal document that spells out the relationship
between you and ArtMLS. It outlines the services, Privacy Policy, pricing,
and the buyer and seller relationship for listing and bidding on items
in ArtMLS's system.
The User Agreement may change. When revisions are needed, changes will
be posted on the site 30 days before taking effect.

| What happens if someone violates the
User Agreement? |

The User Agreement allows ArtMLS to warn or suspend a user if they breach
any part of the User Agreement. Fraudulent and illegal items are strictly
prohibited on ArtMLS. Any seller who attempts to sell prohibited items
or commit fraud will be prosecuted to the fullest extent of the law.

| What does "ArtMLS is only a venue" mean? |
|
ArtMLS is an exciting electronic marketplace where you can buy and sell
Art & Antiques items. However, ArtMLS does not ultimately participate
in the transaction between buyer and seller, verify that items are genuine,
or guarantee that you will receive payment or items. ArtMLS is very concerned
about your safety and offers the services of third parties that can provide
insurance, and escrow for your transactions.

| Why did my offer not show up? |
- To place a offer
on an item at ArtMLS entails two distinct steps.
- 1.
On the listing page, click buyand enter your login, password, and amount
in the spaces provided.
- 2.
Review the information to insure it is correct, and near the bottom
of the page select the button which reads "agree to terms and place
offer" to confirm your offer.

| Why was one listing removed ? |
|
If a listing is ended or removed, it's probably because the item was
prohibited, questionable, infringing or potentially illegal as stated
in the User Agreement and a specific complaint was reported. Listed items
similar to the ones removed will remain on the site unless ArtMLS is notified
about them.
ArtMLS provides a list of prohibited, questionable, infringing and potentially
illegal items that may not be listed on ArtMLS, on the Prohibited
Items page. This is not a complete. If you have consulted the list
and are not sure if an item you would like to sell is legal or not, do
not sell that item without checking with an attorney that may know the
specific laws regarding your item.

| What does Section 6.2 of the User Agreement regarding Your Information
mean? |

Section 6.2. Solely to enable ArtMLS to use the information you supply
us with, so that we are not violating any rights you might have in that
information, you agree to grant us a non-exclusive, worldwide, perpetual,
irrevocable, royalty-free, sublicenseable (through multiple tiers) right
to exercise the copyright and publicity rights (but no other rights) you
have in Your Information, in any media now known or not currently known,
with respect to Your Information. ArtMLS will only use Your Information
in accordance with our Privacy Policy.
This clause allows ArtMLS to host Your Information (as defined in the
User Agreement) on our web site. Because hosting material on a web site
involves copying, ArtMLS needs your permission to store such material
on our servers in order to comply with copyright law.
As stated in the privacy policy. This section of the User Agreement is
absolutely necessary in order for ArtMLS to accept, use, and store your
Information on our servers.

| What does Section 17 of the User Agreement regarding arbitration mean? |
|
Section 17. Arbitration. Any controversy or claim arising out of or relating
to this Agreement or our services shall be settled by binding arbitration
in accordance with the commercial arbitration rules of the American Arbitration
Association. Any such controversy or claim shall be arbitrated on an individual
basis, and shall not be consolidated in any arbitration with any claim
or controversy of any other party. The arbitration shall be conducted
in Deleware and judgment on the arbitration award may be entered into
any court having jurisdiction thereof. Either you or ArtMLS may seek any
interim or preliminary relief from a court of competent jurisdiction Deleware
necessary to protect the rights or property of you or ArtMLS pending the
completion of arbitration.
This clause allows any user that has a dispute with ArtMLS to have that
dispute arbitrated by a neutral third party. Consistent with ArtMLS's
community values, we feel that it is always better to resolve disputes
amicably and quickly if possible, and to this end, arbitration is consistent
with this philosophy.

| I registered. Why does it still say I am an unregistered user? |
|
After filling out the registration form, you will be sent a confirmation
message via e-mail. You must follow the instructions in that message to
complete your registration. This process ensures that your e-mail adress
is correct and functional. Please allow at least 48 hours to receive your
confirmation message.

| I have forgotten my user password. What do I do? |
|
You'll need to submit a request by email : info@artmls.com.
We will send you a special e-mail that will allow you to make the change
on line.

|
Change of E-mail Adress form is available online through our member page
menu.
NOTE: Do not register under the new e-mail adress! Any information associated
with your old e-mail adress could be lost, and Customer Support will need
to manually combine your old and new accounts which could take up to 2
weeks!

We have an online form which you can use to view or modify your registered
user information. The form is on our member page menu.

| I was very pleased/unhappy dealing with someone; what should I do? |
|
If you'd like to give some public feedback, positive or negative, on
another ArtMLS registered user, you can do so using our user feedback
feature. More information about this feature is available at the Feedback
Forum.
If you are making a complaint about someone, please try to resolve the
conflict with that person directly before using the user feedback forum.

| Why did my feedback rating change? I have no new comments. |
|
When a user is unregistered from ArtMLS, all feedback they have left
is changed to neutral although the comments remain. The reason for this
change was to counteract the effect of negative feedback bombing by users
employing alias accounts. This is a suspendable offense, as warned on
the feedback page itself, but in the past, the damage to a user's score
was not fixable. Now it is.
Unfortunately, the only way to implement this policy fairly and equitably
was to make the feature automatic and indiscriminate.

| What is ArtMLS's policy with respect to users of anonymous e-mail? |
|
Anonymous e-mail services, which are typically web-based and free to
use, allow customers to sign up and use e-mail services without providing
verifiable personal information. Examples of services that ArtMLS classifies
as anonymous e-mail providers are HotmailTM, Yahoo!TM Mail and MailExciteTM.
A very small number of people use the anonymity of such services as a
front to abuse web-based services such as ArtMLS. (In contrast, non-anonymous
e-mail services are generally provided by ISPs like AOL, MSNTM and NetcomTM.
These e-mail services require a more formal registration process which
provides more accountability).
At ArtMLS, we believe that people are basically honest, and we wish to
provide an inclusive environment for personal trade. We allow users of
anonymous e-mail to use our site. However, we require new users from anonymous
e-mail services to provide a valid credit card number in order to register.

| How come some of the pictures are not very clear on my monitor? |
|
The picture quality depends on your video card output (you should display
at least 64K colors, sometimes known as 16bit color if you can) and set
your video display resolution as high as you can. We recommend at least
1024x768 with 64K colors. Also, sometimes the pictures are simply lousy.
We have no control over what picture quality is provided by the seller.

| I've buy or sold an item - now what? |
|
So you've buy your item, or you've sold an item. Now what do you do?
Your first move is to contact the other person in the transaction. Sellers
should try to contact buyer within three business days after the offer.
Buyer should also contact the sellers, especially if they haven't heard
back from the seller within three business days. Sellers will not be offended
if you show enthusiasm for the item that you bought. It is the responsibility
of the seller and the buyer to contact one another.
When sellers should contact the buyers usually within three business days)
must provide information on the total cost, including shipping, and where
to send payment. The buyer pays the seller directly for the item(s), and
it is the seller's responsibility to fulfill the order when payment terms
are met. The sell contract of the ad is between the buyer and the seller.
